Terms of Service

1. Acceptance of Terms

By creating an account or using Sport Tracking (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Sport Tracking ("we", "us", or "our"). We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

Sport Tracking is a web-based platform that enables sports clubs, coaches, and families to track athlete performance, manage training programs, and analyse results. The Service supports athletics (track & field), handball, and other sports disciplines.

The Service is offered under two subscription tiers: Basic (limited to one athlete profile) and Pro (unlimited athlete profiles, advanced analytics, and additional features). Feature availability may differ between tiers.

3. User Accounts and Responsibilities

To use the Service you must register an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must provide accurate and complete information during registration and keep your account information up to date. Accounts are personal and may not be transferred or shared with others without our written consent.

New accounts are subject to approval by a platform administrator before access is granted. We reserve the right to decline or revoke account access at our discretion.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws or regulations
• Upload, post, or transmit any content that is false, misleading, defamatory, or harmful
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or harvest data from the Service without our prior written consent
• Use the Service to track athletes without their knowledge or appropriate consent
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate accounts that violate these acceptable use requirements, without prior notice.

5. Data and Content Ownership

You retain ownership of all athlete data, results, and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the Service to you.

We do not claim ownership of your data. We do not sell, rent, or share your User Content with third parties for marketing or advertising purposes.

You are responsible for ensuring that you have the necessary rights and consents to upload data relating to other individuals, including minors. When tracking athletes who are under 18 years of age, you confirm that you have obtained appropriate parental or guardian consent.

6. Subscription and Billing

The Basic plan is available free of charge subject to its feature limitations. The Pro plan is a paid subscription billed on a recurring basis (monthly or annually, as selected at the time of purchase).

Subscription fees are charged in advance and are non-refundable except as required by applicable law. We reserve the right to change pricing with at least 30 days' notice to existing subscribers. If you do not accept a price change, you may cancel your subscription before the new price takes effect.

Failure to pay may result in downgrade to the Basic plan or suspension of your account.

7. Termination

You may close your account at any time by contacting us at legal@sporttracking.app. Upon termination, your access to the Service will cease and your data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your account immediately if you breach these Terms, if required by law, or if we discontinue the Service. We will make reasonable efforts to notify you in advance where practical.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted availability.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or the Service shall not exceed the fees paid by you, if any, in the twelve months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. The EU General Data Protection Regulation (GDPR) and other applicable Swedish and EU consumer protection laws apply where relevant.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Swedish courts, unless mandatory consumer protection laws in your country of residence provide otherwise.
